Special City Council Meeting - 4:00 p.m.
Berkeley council weighs reinstating police tear gas for life-threatening incidents
The Berkeley City Council holds a special meeting on September 29, 2026, with two items on its Action Calendar, both continued from September 15, 2026. The first is a resolution by Councilmember Kesarwani to amend the Council's June 9, 2020 direction so the Berkeley Police Department's Special Response Team could use tear gas when there is a significant risk of injury or death, while keeping the ban on tear gas solely for crowd control and lifting the temporary moratorium on smoke and OC spray. The second is a Peace and Justice Commission recommendation to retain existing bans on chemical weapons, police dogs, and helicopters, keep public reporting of pepper spray use, and ask the City Manager to engage an academic institution to study health impacts. The agenda is otherwise procedural, covering meeting logistics and public comment rules.
- Resolution to let BPD's Special Response Team use tear gas for critical life-threatening incidents only, while maintaining the ban on tear gas solely for crowd control
- Proposal to lift the temporary moratorium on smoke and OC spray
- Peace and Justice Commission recommends retaining 2020 bans on CS and OC chemical weapons and 1982 bans on police dogs and helicopters
- Commission recommends retaining the 1997 requirement for public reporting of each pepper spray use
- Commission asks City Manager to engage UC Berkeley, UCSF, or Stanford to study health impacts of tear gas, chemical weapons, and canine support

Campaign Finance
Berkeley candidates and campaign committees need to file reports of their contributions and expenses following both state and local laws. These reports are accessible to the public online.
Raising and spending money in a Berkeley election
If you raise or spend more than $1,000 on your campaign, you are required to open a campaign committee and file disclosure reports detailing the campaign’s contributions and expenditures. These reports are available to the public online so that voters can access information about money involved in local elections. Review the campaign statement filing schedule for important filing deadlines.
In addition to the disclosure and filing requirements of State of California law, Berkeley has local election laws that you must follow. Known as “BERA”, the Berkeley Election Reform Act applies to candidates running for office, and to anyone raising or spending money in Berkeley elections. The local filing manual is a useful tool for local campaign committees. A commission of Berkeley residents, the Fair Campaign Practices Commission (FCPC) , is tasked with enforcing the requirements in BERA.
Berkeley campaign committees have filing requirements related to mass mailers. Please visit the Mass Mailings page for details. Regulations and resources for campaign committees are provided in the related documents section below.
