DISCUSSION OF COUNCIL MEMBER VACANCY
City Attorney Chris Dowsey reported that City Councilors contacted him with questions related
to the current District lV vacancy including how to expand the pool of applicants, and if more
time is possible to make the appointment. Mr. Dowsey stated that the District lV seat was vacated
on September 7, and the City Charter requires an appointment to the vacant seat within 30 days.
Mr. Dowsey reviewed possible paths forward if an appointment is not made in accordance with
the City Charter and said a specialelection would be the likely result.
City Councilor i. David Reed submitted a written proposal into the record of the meeting asking
City Council to commit to moving forward together by striving for a unanimous decision on the
appointment.

EXECUTIVE SESSION
M ayor M ichael Badagliacco moved that for this executive session an nounced u nd er C. R.S. Section
24-6-4o2(41(bl and (axg) as applicable concerning discussion of a confidential memo addressed
only to Council as well as to discuss the possibility, if appropriate, to hire independent counsel
with regard to this matter; that the city manager, and his employees under the city manager's
direction be excused and not attend.
Objections were raised from other City Council members. The legality of the motion and the
posted purpose of the executive session were discussed. The motion was not seconded.
City Attorney Chris Dowsey stated that he is appointed by City Council and reports to City Council,
but his client is the City of Montrose. Mr. Dowsey reviewed the rules of professional conduct and
ethical standards he must abide by to retain his license through the Colorado Bar.
A discussion was held regarding the ability of City Council to employ special counsel in special
cases as well as the due process rights of employees.

welcome and will be received at any time. The 11:00 p.m. rule will be enforced in accordance with
