Joint Powers Agreement
This Agreement is between the State of Minnesota, acting through its Department of Public Safety on behalf of the
Bureau of Criminal Apprehension ("BCA"), and the County of Morrison on behalf of its Attorney’s Office ("Governmental
Unit"). The BCA and the Governmental Unit may be referred to jointly as “Parties.” As of the date this Agreement is
executed, the ORIs listed in Attachment A are the ORIs that are incorporated by reference and made part of this
agreement.
Recitals
Under Minn. Stat. § 471.59, the BCA and the Governmental Unit are empowered to engage in agreements that are
necessary to exercise their powers. Under Minn. Stat. § 299C.46, the BCA must provide a criminal justice data
communications network to benefit political subdivisions as defined under Minn. Stat. § 299C.46, subd. 2 and subd. 2(a).
The Governmental Unit is authorized by law to utilize the criminal justice data communications network pursuant to the
terms set out in this Agreement. In addition, BCA either maintains repositories of data or has access to repositories of
data that benefit authorized political subdivisions in performing their duties. The Governmental Unit wants to access
data in support of its official duties.

following:
FINDINGS OF FACT
This 119-acre property is in Section 2 of Swan River Township. A registered Tier I dairy feedlot exists.
The property was granted a variance in 2025 to expand the dairy operation within the setback from the
property line.
The applicant requests a Conditional Use permit to expand the dairy to a Tier II (301 to 650 animal units)
The total proposed animal units are 341.6.
The applicant plans to retain the manure for application on their property. The acreage is in Swan River
Township in Morrison County.
Soils are suitable for the stockpiling of solid manure, and eleven months (nine months required) of liquid
manure storage is available.
The OFFSET rating for the proposed feedlot is 94%.

24, 2026 . Based upon the application, information received at the public hearing held on March 17,
2026, the recommendations of staff, and all files and records relating to the application, the Board makes
the following:
FINDINGS OF FACT
The property is in Section 17 of Scandia Valley Township. It is on Shamineau Lake, which is a General
Development Lake. The property is a non-conforming single lot (less than 30,000 square feet and 120
feet wide). The property is 50 feet wide and approximately 2,600 square feet.
This property has a non-conforming dwelling, built in 1970. The dwelling is approximately 20 feet from
the lake and is within the mapped floodplain.
The applicant purchased the property in August 2025 and plans to remove the existing dwelling and use
their replacement-right to construct a new dwelling. Lake Shamineau has been added to the county's
mapped floodplain, so the floodplain elevation requirements for the lowest floor apply to this new build.
Typically, elevation above floodplain is achieved by elevating the construction on fill. Minnesota
floodplain standards require fill to extend 15 feet in all directions from the building. Due to the proximity
of the dwelling to the lake, elevating on fill is not practical.

PURCHASE OF SERVICE AGREEMENT
This Agreement made and entered into by and between the Region 5 Children’s Mental
Health Initiative (consisting of Cass, Crow Wing, Morrison, Todd, and Wadena
Counties) hereafter referred to as the "Initiative," and Reframe Behavior Consulting,
LLC, 101 2nd Ave SE, Suite 180, Perham, MN 56573, hereafter referred to as the
"Provider," entered into and agreed upon for the period from February 1, 2026, to
December 31, 2026.
WHEREAS, pursuant to Minnesota Statute 402.02, subd. 1, the Initiative has
identified a certain population who are in need of mental health services; and
WHEREAS, Minnesota Statutes, Sections 245.461 to 245.486 and 245.4889 to
245.4889 establishes the Minnesota Comprehensive Adult Mental Health Act and
the Comprehensive Children's Mental Health Act; and
WHEREAS, pursuant to Minnesota Statute 402, the Initiative wishes to provide
funding for materials for Support for Intensive In-Home Therapy Services; and
NOW, THEREFORE, in consideration for the mutual undertakings and agreements
hereinafter set forth, the Initiative, and the Provider agree as follows:
I. SERVICES TO BE PROVIDED
A. The Provider shall provide Applied Behavior Analysis (ABA) therapy to
children with autism and related conditions for each of the five counties
within Region 5, including Cass, Crow Wing, Morrison, Todd, and
Wadena Counties.

The above application was considered by the Morrison County Board of Commissioners on
February 24, 2026. Based upon the application, information received at the public hearing held on
February 17, 2026, the recommendations of staff and all files and records relating to the application, the
Board makes the following:
FINDINGS OF FACT
This property consists of three parcels totaling 75 acres. The applicant lives on the property. A Tier I
chicken feedlot exists.
The applicant proposes establishing a Tier II (301 to 650 animal units) chicken feedlot by building an
additional chicken barn, south of the existing barn. The total proposed animal units are 420.
A variance was granted in 2025 to place the additional chicken barn 190 feet from the south property line.
The applicant utilizes transfer agreements for 500 acres for manure application. The acreage is in Buh,
Platte and Green Prairie Townships in Morrison County.
There is an existing stacking slab that serves the current barn; the applicant plans to construct a second
stacking slab to serve the second barn.
The OFFSET rating for the proposed feedlot is 97%.
The applicant has submitted the following plans:
• Morrison County Good Neighbor Plan –The plan identifies that solid manure will be transferred.

Chairperson John Kunelius called the meeting to order at 6:00 pm.

John Kunelius read the opening statement.

A motion was made by John Kunelius to nominate Brent Lindgren for Chairperson. The motion was seconded by
George Sandy. Clint Kathrein stated he would like to cast a white ballot. The vote was all in favor and Brent
Lindgren abstained.
