SPECIAL MEETING
June 22, 2026
The Cherry County Board of Commissioners convened in special session on June 22, 2026 in the
Commissioners Meeting Room of the Cherry County Courthouse, as per notice conspicuously posted on June
15, 2026 at 1:00 p.m. at the following public places: Valentine Public Library, Valentine Post Office, Cherry
County Clerk’s Office, Cherry County Courthouse front door, and the Public Notices section of the Cherry
County website. The current agenda being on file in the office of the County Clerk. The meeting was called to
order at 1:01 p.m. by Chairman McConaughey. Roll call was taken. Present for the meeting were Cherry County
Commissioners Mike McConaughey, Martin DeNaeyer, and Cherry County Clerk Samantha Leonard.
Commissioner Nina Nelson had an excused absence. The Open Meetings Act Poster was acknowledged by
Chairman McConaughey, and the Pledge of Allegiance was recited.
The purpose of the special session was to discuss and adopt Resolution #2026-10 Fund Transfer to the
Emergency Management Fund due to lack of revenue received as budgeted in the fiscal year 2025-2026
adopted budget, and this created a shortfall of funds in the 2650 Emergency Management Fund.

The meeting was called to order at 2:02 pm CDST by chairman Duane Kime in the

be consistent and easily adjust as necessary. Starting Fall 2026, Mr. Hill will begin assessing commercial properties.
Assessor Bancroft stated the office did reviews of farmhouses that have not been assessed in 8-9 years and also put a
5% increase on all grassland.

The Cherry County Board of Commissioners convened as a Board of Corrections on April 28, 2026 in the
Commissioner Meeting Room of the Cherry County Courthouse, as per notice published in the Valentine Midland
News. The current agenda being on file in the office of the County Clerk. The meeting was called to order at 1:30
p.m. by Chairman McConaughey. Present were Commissioners Mike McConaughey, Nina Nelson, Martin DeNaeyer,
County Clerk Samantha Leonard and Justice Administrator Sharon Hesse. The Open Meetings Act Poster was

The Cherry County Board of Commissioners convened as a Board of Equalization on March 10, 2026 in the
Commissioner Meeting Room of the Cherry County Courthouse, as per notice published in the Valentine Midland
News. The current agenda being on file in the office of the County Clerk. The meeting was called to order at 1:00
p.m. by Chairman McConaughey. Present were Commissioners Mike McConaughey, Nina Nelson, Martin DeNaeyer,
County Clerk Samantha Leonard, and County Assessor Melissa Bancroft. The Open Meetings Act Poster was

Assessor Bancroft stated Nebraska State Statute 77-202 clearly states the exclusive benefit of the organization
cannot be for financial gain of the owner or user of the facilities. Attorney Scott stated the daycare provider is self-
employed and does not receive a salary or paycheck. Mr. Scott informed the board the exemption is made bya
county ward basis, and the 5-point test should be looked at as a totality test of the issue and when it’s applied. This
can be taken to TERC; however, the board’s ruling has presumption of validity. Discussion was had that the board

The Cherry County Board of Commissioners convened as a Board of Equalization on February 24, 2026 in the

News. The current agenda being on file in the office of the County Clerk. The meeting was called to order at 1:01

The Cherry County Board of Commissioners convened as a Board of Corrections on February 24, 2026 in the
Commissioner Meeting Room of the Cherry County Courthouse, as per notice published in the Valentine Midland

year 2-5 of the maintenance agreement would be an expense to the county of approximately $4,200/year. At this
time, Ms. Hesse is asking the board to authorize her to move forward to be placed on the list with the Nebraska
State Patrol for the grant. McConaughey moved and DeNaeyer seconded to authorize the Justice Administrator to
work with the Nebraska State Patrol for the LiveScan grant.

BOARD OF CORRECTION MINUTES
January 27, 2026
The Cherry County Board of Commissioners convened as a Board of Corrections on January 27, 2026 in the
Commissioner Meeting Room of the Cherry County Courthouse, as per notice published in the Valentine Midland
News. The current agenda being on file in the office of the County Clerk. The meeting was called to order at 1:32
p.m. by Chairman McConaughey. Present were Commissioners Nina Nelson, Mike McConaughey, Martin DeNaeyer,
County Clerk Samantha Leonard, and Justice Administrator Sharon Hesse. The Open Meetings Act Poster was
acknowledged by Chairman McConaughey.
No comments from the public were received during the allotted time.
Administrator Hesse provided jail and staff update. Ms. Hesse updated that Rick Scheer completed the onsite visit
to begin the process to start installing the Door Access Control System project. Mr. Scheer will be in contact with
Ms. Hesse to begin the installation at a later date.
At 1:41 p.m., Chairman McConaughey adjourned the meeting.
