Please take notice that the Zoning Board of Appeals of the Town of Wheatfield will hold the
following Public Hearing in the Upper Level Conference Room, Town Hall, 2800 Church
Road, Wheatfield, New York. The applicant or the designated representative (in writing)
must attend:
7:05pm: Syncarpha CF II, LLC, requests an area variance for Lot# 161.00-1-39.1, located
on Liberty Dr, to construct a Battery Energy Storage system (BESS). The applicant is
seeking relief for two reasons: the size of the system and the setback requirements. The
Town Zoning code limits the size of the system to one (1) megawatt. The applicant is
requesting to build a five (5) megawatt system. The Town Zoning code also outlines the
setback of a BESS is five hundred (500) feet from any property line. The applicant is
requesting a side yard setback of four hundred fifty-four (454) feet on the East side of the
property.
This proposal was heard on March 9, 2026, and June 8, 2026. It was tabled both
times, so that more information could be submitted to the Board. The variance
request has been moved to a new location.
All persons interested in this matter may appear at the aforementioned specific time and
place and be heard.

The Public Hearing opened at 6:50 pm. A resident who is in the process of submitting an application requests the Town Board look at amendments to code on a case-by-case basis stating everyone who had plans in place is now delayed and at a standstill until amendments are completed. Other comments were how high buildings in residential neighborhoods impact the neighborhood and should be different from other zoning areas. Town Attorney indicated that if and when there is a change in the law people could apply to the Zoning Board of Appeals to get a variance. Resident stated neighbors should have been notified prior to current buildings that size being constructed.

In February 2026, The Zoning Board of Appeals heard a variance request: Adam and Joleigh Wylicki, request
an area variance for 3176 Niagara Falls Blvd, to extend business operating hours. The Town Zoning Code
outlines business hours for an Adult Use Cannabis dispensary – Monday thru Saturday: 9am to 9pm, and Sunday:
12pm to 5pm. The applicants are requesting to be open for business seven days a week from 9am to 10pm.

decision. The Town of Wheatfield Town Board agreed – this is a zoning code/law decision. The

seeking relief for two reasons: the size of the system and the setback requirements. The
Town Zoning code limits the size of the system to one (1) megawatt. The applicant is
requesting to build a five (5) megawatt system. The Town Zoning code also outlines the
setback of a BESS is five hundred (500) feet from any property line. The applicant is
requesting a range of forty (40) feet down to ten (10) feet setback from the side yard of the
property.
This proposal was heard on March 9, 2026. It was tabled so that more information
could be submitted to the Board. The proposal has been moved to a new location.
