The construction for a New Office Building, as approved by the Planning Board on May 1,
2014 has been delayed by the contractor selected by the owner along with long delays due to
construction during Covid, coordination for water and sewer service connections to the
building along with delays by Con Edison.
The owner had been trusting their selected contractor over these many years who had made
numerous non-approved changes to the scope of work affecting the exterior design of the
approved building. These changes include window size (shorter than specified) , stucco
colors, stone veneer and quoin material and dimensions.
The interior of the building is essentially the same as the approved plans.
As the architect, I was not involved in the selection or overseeing of the contractor, except
when I received calls from the Building Department to contact my client regarding issues
with the construction, such as improper roof drains being installed or to provide drawings
to repair the existing top of the rive

advanced the project through further coordination with our consultants and completion of the bidding process.
Based on existing site conditions, findings from the geotechnical report, and updated construction costs, it
became necessary to revisit the building footprint to ensure the project’s overall feasibility. In doing so, we made a
concerted effort to maintain the architectural character of the building and preserve the off-street parking count as
previously presented which includes one tandem parking space. To balance these constraints with current cost conditions,
we reconfigured the building by reducing its footprint and pulling it out of the slope and increasing its setback from
Jackson Avenue.
We have attached the revised Architectural drawings, Stormwater Management Plan and Drainage Report, And
Mechanical drawings for roof top equipment. We respectfully request your consideration for moving this application

Ms. Mayra Aseng from Awnings and Signs, representing business owner of L & L Auto Wash, presented a
revised rendering of the sign. The new sign measures 192 inches by 24 inches. The sign is black with

smaller than previously presented. The applicant has moved the building back to provide
a 10ft. wide sidewalk for pedestrians. There will now be 21ft. between the curb and the

Member Nieminen made a motion to approve the minutes of the November 17, 2025. This motion
was seconded by Chairwoman Raffiani and was carried by the Board with a vote of 2-0.
Item #1 185 Marbledale Road New Sign
Ms. Mayra Aseng from Awnings and Signs, representing business owner of L & L Auto Wash, presented
an application for a new sign. The new sign measures 192 inches by 24 inches. The sign is black with
white and gold letters. The letters for “Hand Car Wash” are white and the letters for “Window Tint” are
gold. The total height of the letters is 18 inches. The sign also has a logo which measures 20 by 24.
Member Nieminen noted that the board cannot approve the sign because it is a description of the
business and not the actual name of the business. It was suggested to put “L & L Auto Wash” in larger
letters and either “Window Tint” or “Detailing & Tints Services” in 3 inch letters, and keep the logo as is.
Member Nieminen stated that the board would have to give a variance for the logo because it is larger
than it’s allowed by code. Member Ringler suggested to put the compounding machines on
