Kent County Boards Tackled Code Updates, Land-Use Requests, and Variances in Early July
Three Kent County boards and commissions met in the second week of July to weigh building code changes, major land-use proposals, and zoning variance applications. Minutes have not yet been published for any of the meetings, so outcomes — including votes and decisions — are not yet part of the public record. What follows is based on the published agendas.
Regional Planning Commission: Data Centers, 94-Lot Subdivision on Agenda
The Kent County Regional Planning Commission met July 9 with a full slate of land-use items.
The most significant proposal on the agenda was Ordinance LC26-06, which would add Data Centers as a permitted use in IL and IG zoning districts. If advanced, the change could shape where large-scale data facilities may locate in the county.
Also on the agenda:
- **SL-26-06 Harmony Hills II** — a request for a 94-lot Major Subdivision consisting of 52 single-family homes and 40 duplexes.
- **S-26-03 Preston Automotive Group** — a site plan for a 50,666 sq. ft. auto dealership, retail, and restaurant space.
- **CZ-26-02 / LC26-10 Taylor** — a request to rezone property from Agricultural Residential (AR) to Neighborhood Business (BN).
- **C-26-04 McCoy** — a request for conditional approval of a home occupation daycare.
The commission was also scheduled to hold elections for Chairperson and Vice-Chairperson.
Because only the agenda is available, it is not yet known which items the commission recommended for approval, denial, or further study.
Building Code Review Committee: 2024 ICC Code Under Discussion
The Building Code Review Committee met July 8 to review the county's existing 2018 ICC (International Code Council) amendments and discuss whether to carry them forward into the 2024 ICC Code. This was the only substantive item on the agenda; the remainder was procedural — call to order, roll call, staff report, setting the next meeting date, and adjournment.
Building codes govern construction standards for safety, energy efficiency, and accessibility. A move to the 2024 ICC Code, if it occurs, would affect future permitting and construction requirements in the county.

Board of Adjustment: Three Public Hearings, Six Pending Decisions
The Kent County Board of Adjustment met July 10 to hold public hearings on three variance applications and to consider notices of decision for six previously heard applications.
The three new variance applications on the agenda were:
- **A-26-15** — Robert E. & Madeline E. Bell, Tax Map No. 9-00-090.01-01-25.00-000
- **A-26-16** — Brenden & Pamela Lapierre, Tax Map No. 8-00-113.00-02-22.10-000
- **A-26-17** — Tigon Golf Carts (Owner: Tigon Real Estate Holdings 4, LLC), Tax Map No. 4-00-046.02-02-01.00-000
The board was also scheduled to deliberate and vote on six earlier applications, A-26-09 through A-26-14, for which public hearings had already been held. Public testimony was limited to five minutes per person per application.
Variances provide property owners relief from specific zoning requirements when strict application would create a hardship. Without published minutes, the outcomes of all nine applications remain unconfirmed.
