Hinckley Council reviews sewer rates, subdivision completion assurance
The Hinckley Town Council met Aug. 20 to discuss a proposed ten-year sewer rate schedule and an ordinance updating subdivision completion-assurance rules, along with an escrow agreement for the Hinckley Topaz Townhomes Subdivision. All items were on the agenda; minutes have not yet been published, so no final decisions are recorded.
Sewer rate schedule
The council discussed Resolution 26-09-03, which would set a ten-year sewer service rate schedule. According to the agenda, the schedule is intended to ensure debt service coverage and fund expenditures. The resolution remains under review.
Subdivision completion assurance
The council considered Ordinance 26-08-20, which would amend Title 11 Land Use, Chapter 19 Subdivision of the town code. The amendment would add a definition for "Completion Assurance" and allow acceptance of an irrevocable letter of credit for improvement guarantees. The council also reviewed an escrow agreement for completion assurance involving Apex Development Partners LLC and the Hinckley Topaz Townhomes Subdivision.
Planning and Zoning Commission
On Aug. 12, the Hinckley Town Planning and Zoning Commission held a public hearing on the same subdivision code changes. The commission discussed adding "completion assurance" to Section 6 definitions and amending Section 21 C.3 to allow irrevocable letters of credit. The commission was expected to make a formal recommendation to the Town Council. Minutes from that hearing have not been published.
