Move that the members of the School Board of the City of Norfolk go into a closed meeting for the purposes which are set out in subsection (A) of section 2.2-3711 of the Virginia Freedom of Information Act (Act), as amended for:
(a) Discussion, consideration, or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of the School Board, pursuant to subsection 2.2-3711 (A) (1) of the Act. The subjects covered by this exemption are the discussion of persons and personnel actions included for vote on today’s personnel report, and discussion of investigations and future personnel actions concerning specific current employees of the school board.
(b) Discussion of the award of a public contract involving the expenditure of public funds where discussion in an open session would adversely affect the bargaining position or negotiating strategy of the public body, pursuant to subsection 2.2-3711 (A) (29) of the Act. The subject covered by this exemption is the discussion of the award of a Comprehensive Agreement under the Public-Private Education Facilities and Infrastructure Act of 2002, Va. Code 56-575.1 et seq. (“PPEA”) to Heartland Construction, Inc. for the final design and construction of a new Maury High School academic building, athletic facilities, and campus.
(c) Consultation with legal counsel and briefing by staff members pertaining to actual or probable litigation or regarding specific legal matters requiring the provision of legal advice by counsel pursuant to subsections 2.2-3711 (A) (7) and (8) of the Act. The subjects covered by this exemption are the advice of counsel regarding the matters set out above in subsections (a) and (b) of this motion.

WHEREAS, the School Board of the City of Norfolk has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the School Board of the City of Norfolk that such closed meeting was conducted in conformity with Virginia law;
NOW, THEREFORE BE IT RESOLVED that the School Board of the City of Norfolk hereby certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed, or considered by the School Board of the City of Norfolk.

A RESOLUTION CERTIFYING AN EXECUTIVE MEETING OF THE SCHOOL BOARD OF THE CITY OF NORFOLK IN ACCORDANCE WITH THE PROVISIONS OF THE VIRGINIA FREEDOM OF INFORMATION ACT. The subject covered by this exemption is the discussion and decision in an employee grievance of a termination, which was previously heard by a hearing officer pursuant to Section 22.1-311 of the Code of Virginia.
(b) Consultation with legal counsel regarding specific legal matters requiring the provision of legal advice by counsel pursuant to subsection 2.2-3711 (A) (8) of the Act. The subject covered by this exemption is consultation in connection with the matter set out above in subsection (a) of this motion, but only to assist the board in writing its decision in the grievance after the board has made and publicly announced its decision, as authorized by subsection E of Section 22.1-313 of the Code of Virginia.

A RESOLUTION CERTIFYING AN EXECUTIVE MEETING OF THE SCHOOL BOARD OF THE CITY OF NORFOLK IN ACCORDANCE WITH THE PROVISIONS OF THE VIRGINIA FREEDOM OF INFORMATION ACT.
WHEREAS, the School Board of the City of Norfolk has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the School Board of the City of Norfolk that such closed meeting was conducted in conformity with Virginia law;
NOW, THEREFORE BE IT RESOLVED that the School Board of the City of Norfolk hereby certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed, or considered by the School Board of the City of Norfolk.

A RESOLUTION CERTIFYING AN EXECUTIVE MEETING OF THE SCHOOL BOARD OF THE CITY OF NORFOLK IN ACCORDANCE WITH THE PROVISIONS OF THE VIRGINIA FREEDOM OF INFORMATION ACT. WHEREAS, the School Board of the City of Norfolk has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the School Board of the City of Norfolk that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE BE IT RESOLVED that the School Board of the City of Norfolk hereby certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed, or considered by the School Board of the City of Norfolk.

Move that the members of the School Board of the City of Norfolk go into a closed meeting for the purposes which are set out in subsection (A) of section 2.2-3711 of the Virginia Freedom of Information Act (Act), as amended for:
(a) Discussion, consideration, or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of the School Board, pursuant to subsection 2.2-3711 (A) (1) of the Act. The subjects covered by this exemption are the discussion of circumstances concerning pending action by the Virginia Board of Education as that affects Dr. Rose’s licensure, contract, and related circumstances, including the temporary status of another specific employee.
(b) Consultation with legal counsel regarding specific legal matters requiring the provision of legal advice by counsel pursuant to subsection 2.2-3711 (A) (8) of the Act. The subjects covered by this exemption are consultation in connection with the matters set out above in subsections (a) of this motion.

A RESOLUTION CERTIFYING AN EXECUTIVE MEETING OF THE SCHOOL BOARD OF THE CITY OF NORFOLK IN ACCORDANCE WITH THE PROVISIONS OF THE VIRGINIA FREEDOM OF INFORMATION ACT.
WHEREAS, the School Board of the City of Norfolk has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the School Board of the City of Norfolk that such closed meeting was conducted in conformity with Virginia law;
NOW, THEREFORE BE IT RESOLVED that the School Board of the City of Norfolk hereby certifies that, to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed, or considered by the School Board of the City of Norfolk.

(a) Discussion, consideration, or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of the School Board, pursuant to subsection 2.2-3711 (A) (1) of the Act. The subjects covered by this exemption are the discussion of persons and personnel actions included on today’s personnel docket.
(b) Discussion or consideration of disciplinary and any other matters concerning students in Norfolk Public Schools that would involve the disclosure of information contained in a scholastic record pursuant to subsection 2.2-3711 (A) (2) of the Act. The subject covered by this exemption is the discussion of students and disciplinary actions on today’s student support docket.
(c) Consultation with legal counsel regarding specific legal matters requiring the provision of legal advice by counsel pursuant to subsection 2.2-3711 (A) (8) of the Act. b) Consultation with legal counsel to obtain legal advice during the hearing of a student’s appeal of a long term suspension, pursuant to subsections (7) and (8) of the above-cited Code section.

Move that the members of the School Board of the City of Norfolk go into a closed meeting for the purposes which are set out in subsection (A) of section 2.2-3711 of the Virginia Freedom of Information Act (Act), as amended for:
(a) Discussion, consideration, or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of the School Board, pursuant to subsection 2.2-3711 (A) (1) of the Act. The subjects covered by this exemption are the discussion of a potential violation of confidentiality in connection with a specific personnel matter and the discussion of specific candidates for appointment to the position of superintendent.
(b) Discussion of the award, terms, or scope of a public contract where discussion in open session would adversely affect the bargaining position or negotiating strategy of the public body, pursuant to subsection 2.2-3711 (A) (29) of the Act. The subject covered by this exemption is the discussion of the award, terms, and scope of a possible superintendent contract.
(c) Consultation with legal counsel regarding specific legal matters requiring the provision of legal advice by counsel pursuant to subsection 2.2-3711 (A) (8) of the Act. The subjects covered by this exemption are consultation in connection with an alleged violation of school board policy and the matters set out above in subsections (a) and (b) of this motion.
