Board of Adjustments & Appeals

Board hears appeal of solar tracker permit alleging height, setback violations

The Cumberland Board of Adjustment and Appeals will hear an appeal of building permit #24-148 issued on June 17, 2024, for a 48-panel pole-mounted solar tracker at 135 Tuttle Road. The appellants argue the structure exceeds the 24-foot height ordinance (max height 30 feet 2.5 inches) and may violate setback requirements due to its 1,139-square-foot footprint. The board must decide whether the Code Enforcement Officer's decision conforms to the Cumberland Zoning Ordinance.
