The State legislation requires local jurisdictions to “adopt a local law authorizing the development of accessory dwelling units” by October 1, 2026. The local law may not impose side and rear setbacks on an accessory dwelling unit that are greater than the side and rear setbacks applicable to other types of accessory buildings, like detached garages and sheds. Also, on-site parking requirements for an accessory dwelling unit cannot be imposed unless supported by a traffic study. To govern these rentals, the Town Council has periodically adopted rental fee rates and usage policies. A committee comprised of Town residents and staff provided input on the rates, policies, and structure reflected in the most recent fee and usage policy, which the Town Council adopted in 2013. I would like to thank Mr. Jim Cole, a member of this committee, for both his comments about the policy at the June 8, 2026 Town Council meeting and the supporting documents and drafts from the 2013 committee that he provided after the June meeting. These were incredibly helpful in tracking the various priorities and concerns that shaped the 2013 policy. Each member of Garrett Park’s three- person Maintenance Team reported to work shortly before midnight on Saturday, January 24, 2026 and did not return home until late Monday evening. Team members continued to work long hours for approximately the next week on post-storm recovery activities. Garrett Park is fortunate to have such a dedicated Maintenance Team, and I wanted to take this opportunity to publicly acknowledge the herculean work performed by Maintenance Supervisor George Miller, Senior Maintenance Assistant Frank Breazeale, and Maintenance Assistant Geovanni “Geo” Meneses. The most visible aspect of the Team’s work during a snow event is plowing Garrett Park’s streets. Provided below are highlights of the report: • Year-to-date investment revenues (Account 5.1) are $35,888 compared to $64,991 for the same time period in the prior fiscal year. A significant portion of the Town’s investment portfolio is with the Montgomery County Investment Pool, which provides earnings on a quarterly basis. We are awaiting the earnings report for the quarter that ended December 31, 2025. • With the Town Council’s adoption of Resolution No. 2025-3 on October 20, 2025, certain Town permits now require the posting of a right -of-way restoration bond. The first such bond was posted during the month of November . A second right-of-way restoration bond was posted in December. The bond postings are noted on the expense and reserve fund summary pages of the financial report. • As of December 31, 2025, Town residents had donated a total of $1,800 for a holiday gift for the Ecology Services staff who take away our trash, recycling, and yard waste. Since the new fiscal year commenced, the Town has received unanticipated revenues and incurred unforeseen expenses. The Town Council introduced Ordinance No. 2026-1 on December 8, 2025. Further information on the proposed budget modifications is provided below. Revenues Proposed Ordinance No. 2026-1 would increase revenues by $232,080. • Account 1.0, Prior Year Carryover – The amount of the prior year carryover (Account 1.0) exceeded the budgeted amount by $26,197. • Account 3.1, From State of Maryland – The Maryland Department of General Services reimbursed the Town for payments it made to Wiedemann Architects under the Design Development Phase Services contract. Matthews, Town Manager Subject: Driveway Permit Standards for Work in Town Right-of-Way Date: January 12, 2026 Background Municipalities have the right to regulate and establish standards for work performed in their right-of-way. During Gene Swearingen’s tenure as Town Manager/Clerk-Treasurer (July 1, 2013 – December 8, 2018), the decision was made that driveway aprons should be constructed in accordance with Montgomery County standards. Jason Azar of Clark | Azar& Associates, the Town’s civil engineering firm, advised that the matter was discussed in conjunction with the Town’s planning for the Safe Routes to School project. Mr. Azar’s association with the Town of Garrett Park dates back to approximately the fall of 2015. Montgomery County standards requires driveway aprons to be concrete with a depth of 7 inches, extending to the property line. Mr. Azar advised that the requirement for 7 inches of concrete is for durability, as driveway aprons are subject to vehicular loading on a regular (daily) basis , including delivery vehicles. Montgomery County would not allow the use of permeable materials in the right -of-way as they will not hold up to daily vehicular traffic, particularly the concentrated load resulting from turning movements. Matthews, Town Manager Subject: Ordinance No. 2026-2 Adoption – Opt In to County Ban on Gas-Powered Leaf Blowers Date: January 12, 2026 Background Montgomery County recently updated its noise law to address the environmental and health concerns associated with gas-powered leaf blowers and leaf vacuums. An amendment to the County Noise Control law banned the sale (2024) and use (effective July 1, 2025) of handheld, backpack, and walk-behind gas- powered leaf removal equipment in Montgomery County. With some exceptions, in order for a Montgomery County ordinance to have effect in the Town of Garrett Park, the Town must affirmatively opt in to the County Code provision. Garrett Park has never opted in to Chapter 31B – Noise Control, under which the County’s ban on the use of gas-powered leaf blowers and leaf vacuums was codified. So, the ban does not apply within the corporate limits of the Town of Garrett Park unless the Town opts into at least that portion of the Noise Control law that addresses leaf blowers, Sec. 31B-9. Procedural History At the March 10 , 2025 meeting of the Town Council, the then-upcoming County ban was discussed; a consensus decision was reached to not opt in to the County noise ordinance at that time.
