Dover boards weigh annexation, data center moratorium, and property appeals
Dover city boards and committees met over the past two weeks to review a range of items, including a proposed annexation and rezoning, a possible moratorium on data centers, and several property code appeals. Minutes from these meetings have not yet been published, so no final decisions are recorded.
City Council: Annexation and rezoning on hearing
On August 10, the Dover City Council held a public hearing and final vote on annexing and rezoning property at 102 Fox Hall Drive (1.639 acres) from Kent County RS-1 to City of Dover R-20. The agenda also included adoption of Annexation Resolution No. 2026-09 for the same property. The council additionally considered appointments to the Planning Commission (Joan E. Denney, 3-year term; Donna Lee Williams, unexpired term), the Dover Public Library Advisory Commission (Annie L. Scott, 5-year term), and DEMEC representative and alternate (Sharon J. Duca and Paul Waddell).
Committee of the Whole: Data center moratorium and other items
On August 11, the City Council Committee of the Whole discussed potential changes to active recreation requirements for residential development, a request for alley abandonment on Liberty Street, adoption of 2024 ICC codes (Proposed Ordinance #2025-19), Delaware Opioid Settlement Commission funding disbursement, and drafting a temporary moratorium for data centers. No final votes were taken at the committee level.
Planning Commission: Warehouse extension, ADA ramp, signage
On August 17, the Planning Commission considered a one-year extension for a warehouse site plan at 601 Garrison Oak Drive (100,000+ square feet), a revised ADA ramp for Legislative Hall at 411 Legislative Avenue, and a public hearing on a signage plan for Dover Commerce Park (32 sq ft sign at 350 Lafferty Lane). The commission also discussed active recreation requirements and held its annual meeting to elect officers.
Board of Adjustment: RV variance at Kings Cliffe
On August 19, the Board of Adjustment held a public hearing on variance V-26-04 from Kings Cliffe MHP, LLC to allow recreational vehicles on four existing non-conforming RV sites at 1131 S. Bay Road. The property is zoned MH and partially in AEOZ Noise Zone A. The agenda noted that 17 RV sites were previously authorized in V-26-03 on June 17, 2026.
Code Board of Appeals: Two property code appeals
The Construction and Property Maintenance Code Board of Appeals met on August 12 to hear an appeal of a citation and fines for a property at 253 Trafalgar Drive (Evan Tulloch) under the 2009 International Property Maintenance Code, Section 304.7 (Roofs and Drainage). On August 20, the Code Board of Appeals heard an appeal of a citation and fees for Indeira Reames at 39 Periwinkle Court, alleging violation of Section 114-2(h) (pruning and removal).
Other meetings
The Economic Development Committee meeting scheduled for August 11 was cancelled; the next meeting is set for September 15, 2026. The Human Relations Commission met August 18 with routine agenda items, including approval of July minutes and committee reports. The Historic District Commission on August 20 reviewed two fence permit referrals: a 6-foot black ornamental metal fence at 103 S. Governors Avenue for Dover Fire Department Station #1, and a 6-foot black-coated chain link fence at 46 S. Bradford Street for People's Church mechanical equipment. The Police Advisory Board held a workshop on August 20 to discuss citizen complaints, community concerns regarding policing, a FAQ flyer on motor vehicle crashes, potential community meetings, and budget possibilities.
