BUSINESS & FINANCE Type Action (Consent) Fiscal Impact No Recommended Action WHEREAS, the Camden City School District (the "District") publicly advertised for bids for Landscaping Maintenance Services (the "Contract") in accordance with the New Jersey Public School Contracts Law, N.J.S.A. 18A:18A-1 et seq.; and WHEREAS, bids were opened on May 15, 2026; and WHEREAS, prior to the scheduled award of the Contract, the Board received a written bid protest from TLC Landscaping Co. dated May 18, 2026, challenging the apparent low bidder's bid on the grounds of alleged material defects in its submission, therefore disqualifying it as the Lowest Responsible Bidder; and WHEREAS, the Board has an obligation to ensure that public contracts are awarded in full compliance with applicable law and to protect the integrity of the public bidding process; and WHEREAS, the Board, upon the advice of its legal counsel, has determined that it is in the best interests of the District to table the award of the Contract pending a thorough review and resolution of the bid protest; and WHEREAS, tabling the award at this time is consistent with the Board's broad discretionary authority to manage and oversee the public procurement process, including the authority to reject all bids or to decline to award a contract where circumstances warrant; NOW, THEREFORE, BE IT RESOLVED by Camden City School District, County of Camden, State of New Jersey, as follows: The foregoing recitals are incorporated herein as if set forth at length. 1. The award of CBOE 2627-01 is hereby tabled pending a full review and resolution of the bid protest submitted by TLC Landscaping Co. 2. The District's legal counsel and the School Business Administrator are directed to review the bid protest, investigate the claims raised therein, and report their findings and recommendations to the State District Superintendent at the earliest practicable date. 3. No contract shall be executed and no work shall commence under the Contract until the District has acted to award or reject the bids following resolution of the bid protest. 4.
